2. Approve the process and funding
The company decides whether to proceed after seeing the legal path and estimate. The EOR confirms the required documents and who will deliver them.
Do not reduce the final amount by a deposit on your own. The deposit may be held against employment obligations until payroll, benefits, taxes, and the exit are reconciled.
3. Deliver notice correctly
The legal employer normally issues the formal employment notice. The employee's manager can join the conversation and explain the business decision, but the spoken message and legal document must agree.
Notice should identify the employer, reason where required, notice period, final date, working expectations, pay, benefits, return-of-property process, and next contact. Translation or a specific delivery method may be required.
4. Manage the notice period
Possible arrangements include:
- Employee continues working and hands over normally.
- Employee remains employed on garden leave.
- Employment ends sooner with lawful pay in lieu.
- Access is restricted while employment and pay continue.
Security access and employment status are separate. You may need to remove production access immediately while continuing salary and benefits through notice.
5. Run final payroll
Final payroll should reconcile every component and use the locally required timing. Some countries require payment on or soon after the last day; others allow the normal payroll cycle.
The employee should receive a payslip and any required separation, tax, benefit, unemployment, or service documents. A single unexplained transfer is not a clean final payroll.
6. Close access, property, and knowledge transfer
Plan device return, password rotation, customer handover, document ownership, expense submission, and data retention. Do not withhold legally required wages merely because a laptop is late. Use the recovery process permitted by local law and the agreement.
7. Reconcile the deposit and records
After final payroll and statutory obligations settle, reconcile any reserve or deposit against actual amounts. Confirm what will be returned, when, and in which currency.
Export and retain the employment agreement, amendments, notice, approvals, payroll records, invoices, and delivery evidence according to your legal and privacy requirements.
